Future reports/work plans submitted to the Central Valley Water Board should be stamped by a <br /> California registered professional engineer or geologist. Future work plans and reports submitted to the <br /> Central Valley Water Board are to be accompanied by a cover letter from you, the responsible party, <br /> stating that the report being transmitting is accurate and true to the best of your knowledge, that you <br /> agree/disagree with your consultant's findings, and should state your recommendations or requests for <br /> the Site (e.g. request for closure, etc.); and, <br /> 7. By 29 April 2016, submit a report documenting the findings of your investigation. Should the <br /> investigation proposed in the Work Plan fail to delineate the lateral or vertical extent of the release, the <br /> report of findings should propose work to further delineate petroleum impacts to soil and groundwater. <br /> In a 22 October 2015 staff letter, Central Valley Water Board staff requested that you notify us of the disposal <br /> method for the petroleum impacted soil excavated in October 2015. On 4 November 2015, Howard Weinberg <br /> informed Central Valley Water Board staff that he intended to remediate the stockpiled petroleum impacted <br /> soil onsite and then use the remediated soil as onsite fill. The stockpiled soil is currently stored on and <br /> covered with plastic sheeting and surrounded by straw waddles that are not properly secured. By <br /> 1 February 2016 submit a description of the means you will employ to remediate the impacted soil, how and <br /> when you will test the soil for hydrocarbons, the cleanup levels you intend to meet, and the best management <br /> practices you will employ to prevent stockpile erosion. It is advisable to consult a Qualified Stormwater <br /> Pollution Prevention Plan (SWPPP) Developer or similarly trained professional to ensure that industry <br /> standards are followed and best management practices (BMPs) are Site appropriate and properly installed. <br /> Once the remediated soil is used as fill onsite, the soil surface must be permanently stabilized to prevent <br /> erosion. <br /> The 22 October 2015 staff letter also requested a report documenting the results of the October 2015 <br /> excavation and the installation and operation of the extraction well [planned infiltration trench]. This report <br /> was due 15 December 2015 and was to include an estimate of the amount of petroleum released and the <br /> amount recovered by excavation and the groundwater extraction system. This report is overdue and should <br /> be submitted as soon as possible. Your cooperation in conducting the cleanup and investigation at the Site is <br /> a determining factor in Central Valley Water Board staffs decision to continue to work with you on a voluntary <br /> basis or recommend you to the Central Valley Water Board for formal enforcement action. <br /> In summary, you need to implement the investigation proposed in the Work Plan, incorporating the above <br /> comments, and submit a report to GeoTracker documenting the results of your investigation by 29 April 2016. <br /> By 1 February 2016, you must notify Central Valley Water Board staff of the means by which you intend to <br /> remediate and manage the petroleum impacted soil currently stockpiled at the Site.
