WASTE DISCHARGE REQUIREMENTS -3- <br /> PARADISE POINT MARINA <br /> SEVEN RESORTS, INC. <br /> SAN JOAQUIN COUNTY <br /> 10. The beneficial uses of Bishop Cut downstream of the discharge are municipal and <br /> domestic, industrial, and agricultural supply; water contact and noncontact recreation; <br /> esthetic enjoyment; navigation; ground water recharge, fresh water replenishment; and <br /> preservation and enhancement of fish, wildlife and other aquatic resources. <br /> 11. The beneficial uses of the underlying ground water are municipal and domestic, <br /> industrial, and agricultural supply. <br /> 12. The State Water Resources Control Board (SWRCB) adopted the California Inland <br /> Surface Waters Plan and the Enclosed Bays and Estuaries Plan (Plans) on 11 April <br /> 1991. On 19 November 1992, the SWRCB adopted amendments to the Plans. The <br /> Plans include water quality objectives and other requirements. This discharge is subject <br /> to the Plans. This Order implements the Plans. The Enclosed Bays and Estuaries Plan <br /> applies to the Sacramento-San Joaquin Delta. However, because the Delta is a <br /> freshwater environment, the numerical water quality objectives from the Inland Surface <br /> Waters Plan shall be applied there. <br /> 13. The Plans allow the Board to excuse a low volume discharger from the requirement to <br /> monitor for the constituents listed in them, if the constituents in the discharge have no <br /> significant adverse impact on water quality. The average daily flow of this discharge is <br /> limited to 0.03 mgd by this Order, and the Board considers it a low volume discharge. <br /> The Board also finds that the discharge will have no significant adverse impact on water <br /> quality. <br /> 14. The State Water Resources Control Board has adopted the Water Quality Control Plan <br /> for the Control of Temperature in the Coastal and Interstate Waters and Enclosed Bays <br /> and Estuaries of California (The Thermal Plan). This discharge is subject to the <br /> requirements of the Thermal Plan and is considered an existing discharge of elevated <br /> temperature waste. <br /> 15. Effluent limitations, and toxic and pretreatment effluent standards established pursuant <br /> to Sections 208(b), 301, 302, 304, and 307 of the Clean Water Act (CWA) and <br /> amendments thereto are applicable to the discharge. <br /> 16. The discharge is presently governed by Waste Discharge Requirements Order No. 89- <br /> 038 , adopted by the Board on 31 March 1989. <br /> 17. The action to adopt an NPDES permit is exempt from the provisions of Chapter 3 of the <br /> California Environmental Quality Act (CEQA) (Public Resources Code Section 21100, <br /> et seq.), in accordance with Section 13389 of the California Water Code. <br />
