BAKER STREET
REAL ESTATE DEVELOPMENT ENVIRONMENTAL HEALTi7 STOCKTON, CA 95203
PERM IT/SERV'$OILS (209)467-3037
Ms. laurie Ootulla, REELS October 30, 1959
San Joaquin County
Environmental Health Dept.
1601 E. Hazelton Street
Stockton, California 95201
Re: 4444 N. Pershing Avenue
Stockton, California
Dear M. Cotu.11a;
After Friday's meeting in Sacramento it is my understanding that the
subject site is far enough in the contamination testing and deta_rminatien
process that your office would be willing to write a "comfort" letter for a
prospective lander and/or future property owner. The purpose of this letter
would assist the property owner is obtaining financing because the lender
would have certain assurances that the building(s) on site would not be
disturbed in the on ding site cleanup by EXXON.
-Ln order to save time, a letter address to me regarding the site's
status and addressing the following issues would be helpful.
1) San Joaquin Qxrrty Public Health Services (S.J.C.P.H.) is the
governing agency responsible for monitoring and enforcing site cleanup.
2) Soil contammatioan has been remedied and Only ground water
contamination, associated with EX30ON's prior use of the site as gas station
remains. Final site certification as a clean site is subject to installation
and maintenance of a remediation system, which has been proposed by EXXON aril
is currently being reviewed by your office. Future modifications and
requirements will not require any adverse changes to our proposed development
(site plan enclosed for your review and information)
3) The start of construction for the proposed development will not
interfere with the cleanup process.
4) Emm has been identified as the responsible party and remediation
and cleanup are currently being discussed with EXXON
5) As long as Exxon continues to perform its obligations to cleanup the
site, your office will not look to a lender or property owner to provide
remediation work. reader and/or property owner must cooperate with your
office and ENNON in the remediation process.
