Cotu.11a; <br /> After Friday's meeting in Sacramento it is my understanding that the <br /> subject site is far enough in the contamination testing and deta_rminatien <br /> process that your office would be willing to write a "comfort" letter for a <br /> prospective lander and/or future property owner. The purpose of this letter <br /> would assist the property owner is obtaining financing because the lender <br /> would have certain assurances that the building(s) on site would not be <br /> disturbed in the on ding site cleanup by EXXON. <br /> -Ln order to save time, a letter address to me regarding the site's <br /> status and addressing the following issues would be helpful. <br /> 1) San Joaquin Qxrrty Public Health Services (S.J.C.P.H.) is the <br /> governing agency responsible for monitoring and enforcing site cleanup. <br /> 2) Soil contammatioan has been remedied and Only ground water <br /> contamination, associated with EX30ON's prior use of the site as gas station <br /> remains. Final site certification as a clean site is subject to installation <br /> and maintenance of a remediation system, which has been proposed by EXXON aril <br /> is currently being reviewed by your office. Future modifications and <br /> requirements will not require any adverse changes to our proposed development <br /> (site plan enclosed for your review and information) <br /> 3) The start of construction for the proposed development will not <br /> interfere with the cleanup process. <br /> 4) Emm has been identified as the responsible party and remediation <br /> and cleanup are currently being discussed with EXXON <br /> 5) As long as Exxon continues to perform its obligations to cleanup the <br /> site, your office will not look to a lender or property owner to provide <br /> remediation work. reader and/or property owner must cooperate with your <br /> office and ENNON in the remediation process. <br />
