Box 2048 Stockton, California 95201 Dear Mr. Sweeten: STOCKTON CROSSROAD FREEWAY/ROY'S AUTO WRECKING YARD - 3570 E. MINER STREET, STOCKTON The Department of Toxic Substances Control (Department) has screened the information contained in the "Soil Quality Investigation" Report for a portion of Roy' s Auto Wrecking property. The information is viewed as preliminary in that the site has not been fully characterized. Enclosed are comments to the report that should be used as guidance in making decisions in conducting further investigation or remediation. As you know, the Department' s Surveillance and Enforcement Branch in conjunction with the San Joaquin District Attorney' s office has an enforcement action against the operator of Roy' s Auto Wrecking Yard for violating the Hazardous Waste Control Law. As a result of his past handling practices, portions of the CalTrans property is contaminated. We concur with the Regional Water Quality Control Board' s assessment that the CalTrans property requires remediation (see September 25, 1991 correspondence) . However, the Department can only assume responsibility for providing oversight of the cleanup if CalTrans enters into a formai agreement as specified in Section 25343 (d) of the Health and Safety Code. Based upon information collected on the auto wrecking yard, a Preliminary Endangerment Assessment will be required to determine if current or past waste management practices has resulted in a release or threatened release of hazardous substances which pose a threat to public health. Therefore, any investigative or remedial actions taken by your office that is independent of our studies may be subject to our review.
