Box 2048 <br /> Stockton, California 95201 <br /> Dear Mr. Sweeten: <br /> STOCKTON CROSSROAD FREEWAY/ROY'S AUTO WRECKING YARD - 3570 E. <br /> MINER STREET, STOCKTON <br /> The Department of Toxic Substances Control (Department) has <br /> screened the information contained in the "Soil Quality <br /> Investigation" Report for a portion of Roy' s Auto Wrecking <br /> property. The information is viewed as preliminary in that the <br /> site has not been fully characterized. Enclosed are comments to <br /> the report that should be used as guidance in making decisions in <br /> conducting further investigation or remediation. <br /> As you know, the Department' s Surveillance and Enforcement <br /> Branch in conjunction with the San Joaquin District Attorney' s <br /> office has an enforcement action against the operator of Roy' s <br /> Auto Wrecking Yard for violating the Hazardous Waste Control Law. <br /> As a result of his past handling practices, portions of the <br /> CalTrans property is contaminated. We concur with the Regional <br /> Water Quality Control Board' s assessment that the CalTrans <br /> property requires remediation (see September 25, 1991 <br /> correspondence) . However, the Department can only assume <br /> responsibility for providing oversight of the cleanup if CalTrans <br /> enters into a formai agreement as specified in Section 25343 (d) <br /> of the Health and Safety Code. <br /> Based upon information collected on the auto wrecking yard, <br /> a Preliminary Endangerment Assessment will be required to <br /> determine if current or past waste management practices has <br /> resulted in a release or threatened release of hazardous <br /> substances which pose a threat to public health. Therefore, any <br /> investigative or remedial actions taken by your office that is <br /> independent of our studies may be subject to our review. <br />
