Cherokee Lane, Lodi <br /> This is an update to the DA referral made to your office in 2004. <br /> A routine underground storage tank (UST) inspection was performed at the <br /> above-mentioned site on 10/31/06 (Attachment 1) by Ray von Flue, Senior REHS <br /> and the following violations were noted: <br /> The 36-month secondary containment testing on the UST's was due on <br /> December 1, 2005 and was not performed until November 15, 2006 (11 <br /> months past due). This is in violation of Title 23, California Code of Regulations <br /> (CCR) 2637(a)(1)— Secondary containment systems installed prior to January 1, <br /> 2001 shall be tested by January 1, 2003 and every 36 months thereafter. <br /> 4The Designated Operator(DO) performing the monthly inspections is not <br /> listed on the statement to this office. D.O. statements were received during <br /> 10/31/06 inspection and additional ones submitted on 11/30/06. Title 23, <br /> CCR 2715(a) Certification, Licensing, and Training Requirements for <br /> Underground Storage Tank Owners, Operators, Installers, Service Technicians, <br /> and Inspectors. <br /> (a) .... The owner shall inform the local agency of any change of designated UST <br /> operator(s) no later than 30 days after the change. This is a repeat violation. <br /> 4DO Reports were not available for review for July and August of 2006. <br /> Reports for July and August 2006 submitted on 1214/06. Title 23, CCR <br /> 2715(e) The owner or operator shall maintain the monthly inspection record and <br /> all attachments for the previous twelve months. This is a repeat violation. <br /> 1 <br />
