Facilities that generate up to one ton of used oil filters per year may store the filters up to one year. Since it cannot be determined how long this waste has been on site, immediately recycle these filters under a bill of lading and submit a copy of the bill of lading to the EHD by 3-17-11. Class 2 Violation. 27. The 55 gallon drum of used oil was left open. All hazardous waste containers shall be closed at all times except when adding or removing waste. Immediately close this container and ensure all hazardous waste containers are closed when not adding or removing waste. Repeat Class 2 Violation. 50. The open 55 gallon drum of used oil has an accumulation start date of 6-30-09. This waste has been on site greater than 180 days. Facilities who generate less than 1000 kg of hazardous waste per month and do not exceed 6000 kg of waste stored on site at any time may store waste on site up to 180 days. Immediately contact a licensed hazardous waste hauler to dispose of this waste under manifest and submit a copy of the manifest to the EHD by 3-17-11. Class 2 Violation. 52. An emergency coordinator and modified contingency plan information is lacking. There must be at least one emergency coordinator on site or on call to coordinate emergency response measures, and the following information must be posted by a phone: the name and phone number of the emergency coordinator; location of fire extinguishers, spill control equipment, and if present, fire alarm; and the phone number of the fire department, unless the facility has a direct alarm. Immediately appoint an emergency coordinator and post the required information by a phone. A form is provided that can be used for this purpose. Submit proof of correction to the EHD by 3-17-11. Repeat Class 2 Violation. 79. A bundle of universal waste lamps are left outside leaning against wall near the dumpster. On the ground outside next to the dumpster lay the broken remains of the universal waste lamp(s). Facility must store universal waste lamps in a closed container and in a manner that prevents breakage and release to the environment. Facility must immediately clean and containerize any broken lamps or releases to the environment. Correct immediately by managing broken or unbroken universal waste lamps correctly. Class 2 Violation. 83. An unmarked/unlabeled bundle of universal waste lamps are left outside leaning against wall near the dumpster. Facility must mark universal waste to identify type of universal waste. Correct immediately labeling these as "universal waste lamps". Class 2 Violation. ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE($122).
