+ 4 <br /> L � <br /> ROB WOOTON <br /> PAGE 3 <br /> considered a responsible party and will not be directed to investigate and <br /> cleanup these releases by PHS-EHD. <br /> In addition, this agency supports and enforces the Federal UST Lender Liability <br /> Rule, which limits the liability of secured creditors who hold an interest in a <br /> facility or property on which a petroleum UST is located, from the time that <br /> person extends the credit up through and including foreclosure and resale. All <br /> told, the environmental liability for property owners near these two release sites <br /> is extremely low, or even more likely, nonexistent. <br /> The boiler fuel tank formerly located in the basement and the approximate four <br /> foot length of remote fill line to this tank (recently found in the sidewalk area) <br /> have been removed from service for some time (15 years). As the former tank <br /> was in the basement, it does not fit the definition of an UST. Therefore, this tank <br /> system would be exempt from UST closure requirements, if it were in existence <br /> today, including the remote fill line. <br /> It is hoped that this letter addresses and alleviates the environmental liability <br /> concerns associated with the various fuel leak sites near the California Building. <br /> There has been tremendous efforts made at the federal and state levels in <br /> promoting and facilitating economic development in areas such as downtown <br /> Stockton, where some environmental degradation has taken place. The <br /> Environmental Protection Agency's Brownfields Economic Redevelopment <br /> Initiative and pending state legislation limiting lender liability are some examples. <br /> PHS-EHD also supports economic development in our community, and most <br /> especially in redevelopment areas.
