AMENDED CONDITIONS OF APPROVAL <br /> GX-90-5 <br /> PAGE THREE <br /> d. The final average elevation on Site B shall be no less tha <br /> 46. 9 feet. <br /> e. All private roads involved in the excavation shall be <br /> maintained so as to control the creation of dust. <br /> f. Excavation operations shall not be carried out during the <br /> hours from 9 : 00 p.m. through 5 : 00 a.m. <br /> g. Any night lighting established on the property shall be <br /> arranged and controlled to not illuminate public rights-of- <br /> way or adjacent properties. <br /> h. A written notification of the work schedule shall be providd <br /> to the County by the applicant prior to any grading r <br /> excavation. The excavation and rehabilitation shall e <br /> completed by August 13 , 1992 . If the excavation does n t <br /> commence within 18 months after the date of approval, the <br /> permit is terminated. <br /> i. To ensure that the excavation is completed in conformance wi h <br /> the approved permit, the applicant shall secure a performan e <br /> bond or other financial security sufficient to cover the cot <br /> of rehabilitation of the site for agricultural use. The fo m <br /> of the bond or other financial security shall be fou d <br /> acceptable by County Counsel. As an alternative, the operator <br /> shall stockpile on the property all material to be removd <br /> from the site pending acceptance of the certification ;f <br /> compliance by the Zoning Administrator. Stockpiled material <br /> shall be set back at least 25-feet from any property line. <br /> j . At the completion of the grading, the applicant shall have a <br /> registered civil engineer or licensed land surveyor compae <br /> the excavation' s final elevations with the approved permi . <br /> The engineer or surveyor shall submit a certified, writt n <br /> finding to the Planning Division which states and documen;s <br /> the compliance or non-compliance of the excavation with the <br /> approved permit. <br />
