Metal fines generated from brake lathe shaving and fly wheel grinder are being recycled as scrap metal without first determining particle size or hazardous properties. Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately stop recycling metal fines, make a hazardous waste determination for the brake lathe shaving, and manage it according the Title 22 hazardous waste regulations. Particles 100 microns or smaller must be handled as hazardous waste if the metal is determined to be a hazardous waste. Submit a statement and supporting documentation explaining how this waste was managed by July 16, 1011. 7. Failed to determine if a waste is a hazardous waste: At time of inspection: Leaking lead acid batteries are placed in a bag with absorbent/neutralizer and than shipped back to the distribution center without a hazardous waste determination made. Ozzymats form the parts washer are placed in a plastic bag and also shipped back to the distribution center. Immediately stop shipping back to the distribution center, make a hazardous waste determination pursuant to Title 22 hazardous waste regulations and handle accordingly or handle as hazardous waste. Within 30 days provide written documentation describing how these waste streams were handled. 18 & 20. 1-clear plastic tote with aerosol can waste was seen labeled with the words"Hazardous Waste-pending further evaluation". The generator name was missing from the label. The start date was 6/24/10. All hazardous waste containers shall be marked with the following information: 1. the words "Hazardous Waste" 2. name and address of generator 3. hazardous properties 4. physical state 5. composition (contents) 6. accumulation start date Immediately label this container and ensure that all containers are marked with all the required information. Since the hazardous waste has been on site greater than 90 days, immediately contact a licensed hazardous waste hauler to dispose of any hazardous waste that has been on site greater than 90 days, under manifest and submit a copy of the manifest to the EHD by July 16, 2011. 23. 1-55 gallon drum of drained used oil filters were seen open. Used oil filters must be stored in a closed, rainproof container, labeled as "drained used oil filters," and marked with an accumulation start date. Immediately close and properly label and ensure that all used oil filters are managed in this way. 32. Failed to comply with new HW tank system assessment requirements: At time of inspection: Facility did not have tank assessment for the hazardous waste tanks, used oil, waste antifreeze, and waste water on site pursuant to 66265.192 CCR. Immediately have a tank assessment prepared for hazardous waste tank(s), pursuant to 66265.192 CCR. Within 30 days submit a copy to this office for review.
