Cherokee, Stockton Program: HW SUMMARY OF VIOLATIONS CLASS I, CLASS II, or MINOR -Notice to Comply) This is a follow-up hazardous waste inspection of the referenced facility billable at current San Joaquin County Environmental Health Department (EHD) hourly rate. The following Item #20 is a Repeat Class II violation, and #8,11, and 23 are Minor Violations - Notice to Comply. 8. This facility's EPA ID number is inactive. -- A hazardous waste generator shall not treat, store, dispose of, transport or offer for transportation, hazardous waste without an EPA ID number. * Immediately contact DTSC and reactivate your EPA ID number and submit evidence to the EHD by June 20, 2011. A form has been provided. 11. Observed oil on shop floor leaked from removed engines waiting to be recycled as scrap metal. -- Facilities shall be maintained and operated to minimize the possibility of a fire, explosion, or release of hazardous waste to air, soil, or surface water which could threaten human health or the environment. Immediately , and manage according to Title 22 hazardous waste regulations. * Submit a statement and supporting documentation explaining how this waste was managed by June 20, 2011. 20. (Repeat) Missing accumulation start date on label of two 55 -gallon used -oil containers. -- All hazardous waste containers shall be marked with the following information: 1. the words "Hazardous Waste", 2. name and address of generator, 3. hazardous properties 4. physical state, 5. composition (contents), 6. accumulation start date * Immediately label these containers and ensure that all containers are marked with all the required - information. + Owner provided disposal receipts of used oil dated March 8, 2011, and stated the latest new accumulation start date wasn't put on because the labels had run out of space. The new accumulation start date was marked on a new hazardous waste label. Violation has been corrected on site. 23. Bills of lading for the recycling of used oil filters for the last three years were not found on site. Generator stated they had never been kept in the past. -- A copy of each bill of lading must be kept on site for at least three years. Facilities that generate up to one ton of used oil filters per year may store the filters up to one year. * Immediately begin maintaining them on site, and submit a statement that this will be complied to the EHD by June 20, 2011. ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE ($122).
