Perform a hazardous waste determination on the above waste streams and provide <br />to this office by June 10, 2016. <br />Violation 106, CCR 66265.51(b). Failed to implement a contingency plan. <br />The facility had hazardous waste releases onsite and failed to implement a contingency plan. <br />(a) Each owner or operator shall have a contingency plan for the facility. The contingency plan <br />shall be designed to minimize hazards to human health or the environment from fires, <br />explosions, or any unplanned sudden or non -sudden release of hazardous waste or hazardous <br />waste constituents to air, soil, or surface water. <br />(b) The provisions of the plan shall be carried out immediately whenever there is a fire, <br />explosion, or release of hazardous waste or hazardous waste constituents which could threaten <br />human health or the environment. <br />Immediately, implement a facility contingency plan whenever there is a release of <br />hazardous waste or hazardous waste constituents which could threaten human <br />health or the environment <br />Violation 107, CCR 66265.52. Contingency plan is incomplete. <br />The facility contingency plan did not include all required items. (a) The contingency plan shall <br />describe the actions facility personnel shall take to comply with sections 66265.51 and 66265.56 <br />in response to fires, explosions, or any unplanned sudden or non -sudden release of hazardous <br />waste or hazardous waste constituents to air, soil, or surface water at the facility. <br />(b) If the owner or operator has already prepared a Spill Prevention, Control, and <br />Countermeasures (SPCC) Plan in accordance with 40 CFR Part 112, or 40 CFR Part 1510, or <br />some other emergency or contingency plan, the owner or operator need only amend that plan <br />Page 9 of 39 <br />
