Channel, Stockton <br />Program: HW <br />SUMMARY OF VIOLATIONS <br />CLASS I, CLASS II, or MINOR -Notice to Comply) <br />This is the final version of the Official Inspection Report. This version supersedes the previous <br />Checklist Only provided on 6/1812014. <br />(Violation #108 continues from Page 6) <br />o At "Building Southeast" (an intermodal freight container) <br />- Unknown 55 -gallon metal drums inside building (Photo #41), and poly drums outside (Photo #42) <br />- Leaking boxes of unknown content, and boxes labelled Triehanolamine, flammable liquid, Pomak <br />4 T&M Oil, and Formaldehyde (Photos #47,48, 49). Unknown if the content are still usable <br />materials or have become waste due to signs of leakage. <br />Generator shall make hazardous waste determination of the waste and manage the waste accordingly. <br />Immediately make a hazardous waste determination of the above wastes and manage each accordingly, <br />or dispose of the waste as hazardous waste in accordance to California Code of Regulations (CCR) Title <br />22. In addition, size of hazardous metal particles must be determined before they can be recycled as <br />scrap metal. Hazardous metal particles 100 microns or smaller cannot be recycled but must be <br />disposed as hazardous waste. If you determined the waste to be a non -hazardous, please provide to <br />EHD the rationale and evidence (i.e. third party laboratory testing results) supporting such a <br />determination. Submit a statement and supporting documentation explaining how this waste was <br />managed by 9115/2014. <br />116. Failed to provide annual review of initial training for personnel in 2013, and failed to return to <br />compliance for the same violation cited in the 08/30/2013 Report. Per California Code of Regulations <br />(CCR) 26265.16(c), facility personnel shall take part in an annual review of the initial training for <br />hazardous waste management including spill prevention and contingency plan implementation <br />procedures in accordance to CCR 26265.16(a). Immediately provide annual review of initial training to <br />personnel and submit evidence and description of the training to EHD by 9115/2014. <br />122 & 125. Copies of hazardous waste disposal records for the last three years were not found on site, <br />and failed to return to compliance for the same violation cited in the 08/30/2013 Report. Hazardous <br />waste generators shall retain copies of all manifests signed off by the disposal facility and all receipts <br />used in a consolidated manifesting procedure on site for three years and have them readily available for <br />review.
