(Ryder) is <br />forwarding this letter in response to the Notice of Violation issued by the County of San <br />Joaquin for the referenced facility. This notice identified issues requiring a response. The <br />issues are identified below along with Ryder's response and/or action plan: <br />#1 Violation text: The monitoring plan on site is not current, it states that the <br />overfill prevention for all tanks on site is mechanical flappers set at 95%. The <br />used oil tank does not have a flapper. The used oil tank was observed to <br />activate an audiblelvisual alarm at 90% capacity. The monitoring and response <br />plans must be current and approved by the EHD. Complete and submit a copy <br />of the updated monitoring plan for approval to the EHD by February 9, 2012. <br />An approved copy will be returned for your records. REPEAT VIOLATION <br />Ryder Fuel Services has made the necessary changes to the monitoring plan for <br />the facility. The original and a copy of the plan are included as part of this <br />response. <br />#2 Violation text: 109 Annual monitoring system certification, leak detector <br />testing, and spill containment testing was performed on January 18, 2011 and a <br />test report was submitted to the EHD on March 3, 2011. A copy of the test <br />report must be submitted within 30 days of the tests.
