Ms. Stacy Rivera San Joaquin County EHD Ryder Fuel Services has made the necessary changes to the contingency plan for the facility. A copy of the plan has been uploaded to CERS and is included as part of this response. #2 Violation text: #135 — HSC 25185(c)(3) — Failed to submit a written response within 30 days of receiving an inspection report. The Return to Compliance paperwork for the August 19, 2013 inspection was not submitted. A deficiency letter was issued on December 2, 2013. The operator of the site or facility which receives an inspection report shall submit a written response to the department or the local officer or agency within 60 days of receipt of the inspection report, or within a shorter time as the department or local agency requires. This response shall include a statement documenting the corrective actions that have been or will be taken by the operator. Immediately submit all necessary follow up paperwork for the 2013 hazardous waste generator inspection to tine EHD. REPEAT VIOLATION The Return to Compliance paperwork and all documentation requested during the August 2013 inspection is included as part of this response. #3 Violation text: #605 — CCR 66262.34(f) — Filed to completely label containers or tanks of hazardous waste. A SS gallon black steel drum of spent absorbent was observed in the back storage area with no hazardous properly marked All hazardous waste containers shall be marked with the following information: • the words "Hazardous Waste" • name and address of generator • hazardous properties (flammable, corrosive, reactive, toxic) • physical state (liquid, solid) • composition (contents) • accumulation date The label was corrected at the time of the inspection. REPEAT VIOLATION This issue was corrected at the time of the inspection. #4 Violation text: #108 — CCR 2637 Secondary containment: (a) test not performed, (e) test report not submitted within: 30 days; (f)test notification not provided to the EHD at least 48 hours prior to conducting the test. The reserve diesel fill sump and used oil fill sumps were repaired on July 3, 2012 and six month testing was due January 2013. Testing has not been completed and is 12 months past due. Secondary containment testing is required six months after installation and at least every 36 months after. Immediately schedule this test and provide 48 hours notification to the EHD. Ryder Fuel Services contracted with Balch Petroleum to conduct the required testing. This testing was completed on January 31, 2014. A copyft�CLIVED included as part of this response.
