On December,27, 2002, the <br /> secondary containment testing of this tank was performed. The annular space failed the secondary <br /> containment test (Attachment 1). On January 13, 2003, the Environmental Health Department (EHD) <br /> received a letter from the owner, Mr. Robert McElravy, stating that the annular space had failed and that <br /> he would like a list of repair contractors (Attachment 2). On January 31, 2003, Ray von Flue faxed a list <br /> of repair contactors to Mr. McElravy per his request. Included in the fax to Mr. McElravy was a note that <br /> informed him that he had until April 27, 2003 to make the necessary repairs(Attachment 3). On April 28, <br /> 2003, EHD received a letter stating that Mr. McElravy had hired a contractor to remove the waste oil <br /> tank. Included in the letter to EHD was a copy of the check paid to the removal contractor (Herbst <br /> Engineering) and the removal cost proposal (Attachment 4). <br /> On June 2, 2003, Michelle Le, Senior REHS, performed a routine underground storage tank inspection <br /> and found that this facility was occupied by a new owner, Mr. Scott Johnson. Per Mr. Johnson, he was <br /> still using the underground waste oil tank, but the tank belonged to Mr. McElravy and that contingent <br /> upon his purchase of the business, Mr. McElravy would remove the waste oil tank. Ms. Le wrote an <br /> inspection report that required a new owner information document to be submitted, as well as, financial <br /> responsibility information, monitoring and response plan. The inspection report also informed Mr. <br /> Johnson that he must perform a monitoring certification on the waste oil tank by July 2, 2003. Mr. <br /> Johnson was also told he must address the failed annular space by repairing, closing or removing the <br /> waste oil tank by July 2, 2003. (Attachment 5) <br /> On June 27, 2003, EHD received a copy of a letter from Robert McElravy sent to the removal contractor, <br /> Herbst Engineering dated 6/25/03 (Attachment 6). This letter requested information from the contractor <br /> regarding when the removal permit would be obtained. <br /> 1 <br />
