CCR 2632(b) Owners or operators of underground storage tanks subject to this section shall <br /> implement-a.monitoring program approved by the local agency and specified in the underground <br /> storage tank operating permit. <br /> -*A monitoring and response plan has not been submitted to this office for approval. <br /> CCR 2712(i) A copy of the permit and all conditions and attachments, including monitoring plans, <br /> shall be retained at the facility. <br /> -+A monitoring and response plan was not found at the facility on July 1, 2002 during a routine <br /> inspection. <br /> Health & Safety Code (HSC) 25291 (a)(2) Any person who knowingly, or with reckless disregard for <br /> the risk, treats, handles, transports, disposes, or stores any hazardous waste in a manner which causes <br /> any unreasonable risk of fire, explosion, serious injury, or death is guilty of a public offense and shall, <br /> upon conviction, be punished by a fine of not less than five thousand dollars ($5,000) nor more than <br /> two hundred fifty thousand dollars ($250,000) for each day of violation, or by imprisonment in a <br /> county jail for not more than one year, or by imprisonment in the state prison, or by both the fine and <br /> imprisonment. <br /> ->Used oil was being stored in and underground storage tank that is out of compliance with Health <br /> & Safety Code Chapter 6.5 and California Code of Regulations Chapter 16. <br /> CCR 66265.51 (a) Each owner or operator shall have a contingency plan for the facility. The <br /> contingency plan shall be designed to minimize hazards to human health or the environment from fires, <br /> explosions, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> constituents to air, soil, or surface water. <br /> _+New operator did not have a contingency plan. <br /> CCR 66262.12(a) Except as specified in (d), a generator shall not treat, store, dispose or transport or <br /> offer for transportation,hazardous waste without having received an Identification Number. <br /> -+This facility does not have an active EPA ID number. <br /> V.
