Schulte Road <br />Tracy, CA 95377 <br />Re: Notice of Compliance <br />SPCC Case No.: 06-4042 <br />Inspection Date: 03-17-06 <br />Inspector: Mr. Mark Calhoon <br />Dear Mr. Kindy: <br />Pursuant to the Oil Pollution Act of 1990 and the associated oil pollution prevention <br />regulations found in Title 40 of the Code of Federal Regulations ("C.F.R.") Part 112, a <br />representative from the United States Environmental Protection Agency ('U.S. EPA") performed <br />a Spill Prevention Control and Countermeasure ("SPCC") inspection on March 17, 2006, at the <br />Safeway Distribution Center located in Tracy, California. The U.S. EPA has determined that the <br />facility is subject to the requirements of 40 C.F.R. Part 112 because it is a non -transportation <br />related on -shore oil production facility with a total aboveground storage capacity greater than <br />1,320 gallons and which, due to its location, could reasonably be expected to discharge oil in <br />harmful quantities into or upon the navigable waters of the United States or adjoining shorelines. <br />At the time of the inspection, the facility was found to be in compliance with the existing <br />SPCC regulations. U.S. EPA appreciates your company's commitment to SPCC compliance <br />and the prevention of oil spills to navigable waters. While the facility was found to be <br />substantially in compliance, the following areas of concern were noted and are brought to your <br />attention. <br />
