Union Pacific Railroad Company <br /> San Joaquin County Superior Court Case No. CV 025305 <br /> Addendum to Master File Record <br /> Dear Sir/Madam: <br /> This office represents the City of Tracy with respect to the above-entitled legal <br /> proceedings. The purpose of these proceedings was for the City to obtain court permission to <br /> enter on property owned by Union Pacific Railroad near downtown Tracy, for the purpose of <br /> environmental testing. The City has obtained such permission from the court. Attached to this <br /> letter is a true and correct copy of the court's January 21, 2005 order with respect to this matter. <br /> Geocon Consultants, Inc. will be performing the environmental testing on behalf of the City. <br /> We understand that it is necessary for the accompanying Master File Record to be signed <br /> prior to obtaining a permit from your department. On behalf of the City, we have filled out this <br /> form and have had it signed by Julie Yuan-Miu, Assistant City Manager. The Master File <br /> Record has been signed on the assumption that your department understand that the City is not <br /> the owner or operator of the subject property. UPRR is still the owner. The environmental <br /> studies to be conducted are for the purpose of the City being able to decide whether or not it <br /> wishes to purchase the property. Such a decision has not been made. <br />
