Accordingly, at this time <br /> and until UPRR' claims with the SBE and DTSC are resolved, UPRR <br /> proposes to pay the minimum hazardous waste generator permit fee <br /> to the County. After the hazardous waste issue is resolved with <br /> the State, UPRR will pay any additional amount owed to the County <br /> or seek a refun for any overpayment. Also, this letter <br /> constitutes a c aim for refund for any amounts that UPRR already <br /> overpaid for th years 1992 -1996 as a result of the <br /> mischaracterization of its waste as "hazardous . " <br /> Please issu a corrected invoice to UPRR reflecting the <br /> hazardous waste enerator fee applicable to generators of 5 tons , <br /> but less than 25 tons - - $337 . 10 . On December 29 , 1996 , UPRR paid <br /> $3 , 371 . 00 to the County. Accordingly, based on available <br /> information, UPR already has overpaid its 1997 generator taxes by <br /> $3 , 033 .90 . As n ted above, we will seek an adjustment based on <br /> the outcome of U RR' s appeal to the SBE .
