You called as a <br /> follow-up of our ongoing discussions of your request that, in addition to the terms of the <br /> settlement in principle reached by San Joaquin County and Union Oil Company of California <br /> ("Union.Oil") on February 17, 1999,. Union Oil withdraw its petition for closure of the 1665 <br /> Pacific Avenue site that has been pending before the State Water Resources Control Board (the <br /> "State Board") since May 1997. <br /> You informed me that you are aware that the ,State Board will adopt the staff <br /> recommendation to close the site, that you disagree with staffs recommendation, and that unless <br /> Union Oil withdraws the petition before the State Board avis on it,. the San Joaquin County <br /> District Attorney's Office will-4$le suit against Union Oil in.the San Joaquin County Superior <br /> Court. We have consulted the State Board's web site and noted that the petition is not on the <br /> May 1999 workshop calendar. <br /> You confirmed that as far as you are concerned"'there is no settlement in principle <br /> or otherwise" between San Joaquin County and Union Oil unless the petition is withdrawn and <br /> Union Oil agrees to spend at least another $200,000 "removing gasoline from the ground" at the <br /> EXHIBIT 14 <br />
