We, of course, are disappointed that PHS/EHD continues to disagree with the <br /> conclusion that the site has been adequately characterized and is self-remediating through <br /> natural attenuation and intrinsic biodegradation. <br /> You are aware that Unocal has a petition for closure of this site pending before the State <br /> Water Resources Control Board(the "State Board") and that the staff has circulated a <br /> draft order closing the site. As we have stated a number of times, Unocal will abide by <br /> the State Board's decision whatever it is. If the State Board closes the site, no further <br /> action will be required and Unocal will concentrate its efforts on completing corrective <br /> action at its other former service station sites. If the site is not closed, Unocal will <br /> continue to perform whatever additional corrective action is appropriate for closure. <br /> We are. therefore. requesting the PHS/EHD extend the July.1, 1999 deadline for the <br /> submission of a workplan for additional work, as set forth in your May 4, 1999 letter, <br /> until after the State Board issues a decision on Unocal's position. <br /> EXHIBIT 15 <br />
