While we <br /> have to tried to achieve this submittal date, it became clear on <br /> September 28, 1993, that we could not make this date. You may <br /> not appreciate this delay, but I am compelled to explain this to <br /> you. <br /> On September 16, 1993, we received a proposal from McLaren <br /> Hart regarding the next phase of work including the soil remedial <br /> work plan, further site characterization, a soil vapor extraction <br /> pilot test, the feasibility study, and the corresponding reports. <br /> Because the property owner is a non-California limited <br /> partnership, the parties authorized by the general partners to <br /> make decisions had also requested bids from several consultants. <br /> While Boettcher is not eligible to seek reimbursement from the SB <br /> 2004 Fund, the invitation bids were necessary to fulfill the <br /> fiduciary duties of the general partners to the 2000 or so <br /> limited partner investors expenditures by the limited partnership <br /> are reasonable. . <br /> Unfortunately we did not receive the bids by telefax until <br /> after the close of business on September 24, 1993. (Attached are <br /> the cover pages of the bids for verification. ) We have discussed <br /> the various bid proposals with the client, but have not been <br /> authorized to accept any single bid. Until a bid is selected, no <br /> consultant is willing to working on preparing the soil remedial <br /> work plan.
