The responsible party, Mrs. <br /> Edna Moore, is out of compliance pursuant to California Code of Regulations, Division 3, <br /> Chapter 16, Article 11, having failed to comply with directives from the EHD that included <br /> submitting reports to this department and to GeoTracker, the State Water Resources Control <br /> Board database program, for the: <br /> • Vapor intrusion evaluation; <br /> • Monitoring and sampling of groundwater in 2010; and <br /> • Implementing the soil vapor extraction (SVE) pilot test. <br /> By letter dated 07 May 2010, the EHD had directed that the SVE pilot test be completed within <br /> thirty days of the date of the letter and the report of findings be submitted to the EHD within <br /> thirty days of completing the SVE pilot test; that all wells be monitored and groundwater <br /> samples be collected from MW-1 and MW-5 through MW-8 during the second quarter 2010, <br /> and the semi-annual collection of groundwater samples from MW-1 be resumed; and the <br /> vapor intrusion evaluation be submitted to the EHD by 05 August 2010. Having not received <br /> any of the above-requested reports, by letter dated 20 August 2010, the EHD had directed the <br /> submittals of the above-requested reports within fourteen days of the date of the letter. <br /> Receiving no response to these directives, the EHD scheduled an administrative meeting for <br /> 30 November 2010; however, Mrs. Edna Moore failed to attend this meeting. Mrs. Moore's <br /> consultant, Advanced GeoEnvironmental, Inc. (AGE), informed the EHD by voice-mail that <br /> Mrs. Moore would not attend the meeting and had instructed AGE not to attend the meeting, <br /> and reportedly indicated a preference for a site referral to your agency. <br />
