River Road <br /> Ripon, CA 95366 <br /> NOTICE OF VIOLATION, NON-SUBMITTAL OF TECHNICAL REPORT, RJM ENTERPRISES, <br /> SAN JOAQUIN COUNTY <br /> Regional Board staff have recently reviewed the case file and determined that RJM Enterprises, doing <br /> business as McManis Family Vineyards (RJM) is operating its winery wastewater treatment system in <br /> violation of Waste Discharge Requirements (WDRs) Order No. 5-00-021. RJM has failed to comply <br /> with effluent concentration limits and failed to submit technical reports required by the WDRs as <br /> described by the following: <br /> • Provision E.1 requires compliance with Discharge Specification B.4 within two years of adoption <br /> of the WDRs. The Order was adopted on 28 January 2000; therefore, the compliance date is <br /> 28 January 2002. Discharge Specification B.4 includes a total dissolved solids (TDS) <br /> concentration limit of 450 mg/1 with a monthly average of 1,000 mg/1. Review of recent self <br /> monitoring reports indicates effluent has exceeded that standard since January 2002. <br /> Concentrations of TDS have ranged from 1,240 mg/l to 13,500 mg/1 with an average value of <br /> 5,783 mg/l. <br /> California Water Code Section 13173b defines designated waste as "...contains pollutants that, <br /> under ambient environmental conditions at a waste management unit could be released in <br /> concentrations exceeding applicable water quality objectives or that could reasonably be <br /> expected to affect beneficial uses of the waters of the state... " Because background groundwater <br /> concentrations of TDS are approximately 400 mg/l, nearly all of the concentration data presented <br /> in the self-monitoring reports indicate designated waste is being stored and discharged from the <br /> pond. Storage of designated waste must comply with the California Code of Regulations Title 27. <br /> If RJM cannot comply with the effluent limits presented in the WDRs,then a Report of Waste <br /> Discharge consistent with Title 27 Sections 21710, 21740, 21750, and 21760 shall be submitted. <br /> However, staff will await completion of the Groundwater Monitoring Summary Report (described <br /> below) prior to making a final determination of the status of the wastewater. In the meantime, <br /> RJM shall take all reasonable steps to reduce the TDS concentration of its wastewater. <br /> Provision EA requires a Groundwater Monitoring Summary Report to be submitted by 15 August <br /> 2001.
