The Discharger shall apply to the Board for another NPDES permit at least six months <br /> prior to the time that alternative discharge arrangements are needed. The Discharger shall <br /> submit for Executive Officer appro <br /> for timing of val an engineered report which will provide the basis <br /> the permit application submittal. The report shall be prepared by a <br /> Registered Professional Engineer and shall contain a pond capacity evaluation, an analysis <br /> demonstrating that all land discharge options will be exhausted, and a proposed flow <br /> amount that will trigger submittal of the new permit application. The report shall be <br /> submitted for Executive Officer approval no later than 30 April 1999. <br /> 4. The Discharger shall use the best practicable cost-effective control technique currently <br /> available to limit mineralization to no more than a reasonable increment. <br /> 5. In the event of any change in control or ownership of land or waste discharge facilities <br /> described herein,the Discharger shall notify the succeeding owner or operator of the <br /> existence of this Order by letter, a copy of which shall be immediately forwarded to this <br /> office. <br /> 6. At least 90 days prior to termination or expiration of any lease, contract, or agreement <br /> involving disposal or reclamation areas or off-site reuse of effluent, used to justify th <br /> rshall <br /> e <br /> capacity authorized herein and assure compliance with this Orde , the Discharger <br /> notify the Board in writing of the situation and of what measures have been taken <br /> being taken to assure 111111 compliance with this Order. are <br />
