Hwy 12 <br /> Victor, Ca <br /> This letter is being sent to appraise you of a recent telephone conversation between San Joaquin County <br /> Public Health Services, Environmental Division (PHS/EHD) and your attorney, Richard Macey, and to <br /> present some important information for your consideration. <br /> The current sample results from the soil currently stockpiled at the Treehouse Nursery were discussed <br /> over the phone, specificaily a total lead value of 500.0 mg/kg and a soluble lead value of 11.0 mg/l. <br /> Pursuant to Title 22 of the California Code of Regulation; (section 66261.2 et. seq.) any waste <br /> containing a soluble lead level of 5.0 mg/1 or more is considered to be a hazardous waste. <br /> Consequently, the storage and disposal options for this stockpile are now governed and restricted by <br /> California law. Title 22 also specifies that soil designated as hazardous must be shipped as hazardous <br /> waste under manifest and can be accepted only at facilities permitted to accept such waste. <br /> In addition, Title 22 further specifies that hazardous waste can be stored on site for a maximum of 90 <br /> days from the date it is found to be at hazardous levels. Therefore, after 90 days from the receipt of this <br /> 4 <br /> letter, you must dispose of the stockpiled soil to an acceptable facility. <br /> A copy of the completed shipping manifest and the receipt of acceptance from the proper facility should <br /> be submitted to this office.
