Tokay Street j <br /> Lodi, California 95240 <br /> Subject: Additional Permit Revision Request <br /> Tower Park Marina, Lodi, California <br /> Law/Crandall Project No. 31-1548 i <br /> I <br /> Dear Mr. Sternfels: <br /> We have received the revised permit dated October 8, 1992 to drill and install groundwater <br /> monitoring wells and soil test borings and to implement interim remedial actions at the <br /> Tower Park Marina, 14900 West Highway 12, Lodi, California. A copy of the permit is <br /> included as Attachment A. We have several concerns regarding technical permit conditions <br /> which are listed on Attachment B. Per Condition 10 of the revised permit, Mr. Tom <br /> Rosten, Reclamation District Engineer, is authorized to amend technical conditions of the <br /> permit. By copying Mr. Rosten on this letter, we are requesting revisions to the technical <br /> permit conditions. However, as discussed with you on the telephone on October 18, 1992, <br /> our major concern is the indemnification clause (Permit Condition 6). We are unable to <br /> agree to the indemnification clause as it stands. We are requesting that the indemnification 1 <br /> clause be revised to read as follows; requested changes are highlighted. <br /> Permitees shall indemnify Reclamation District # 548, its trustees, officers, engineers <br /> and attorneys ("Indemnitees") and hold them and each of them harmless from and <br /> provide a defense to each Indemnitee, for any loss, liability, claims, lawsuits <br /> (threatened or filed) or injuries, whether or not well founded to the extent resulting <br /> from or incurred as a result of the negligent acts or omissions of Permitees, their <br /> agents, employees or servants relating to the permitted work, and the negligent acts or <br /> omissions of Permitees, their agents, employees or servants relating to the permitted <br /> work or any other negligent act or omission related thereto.
