APPEAL OF JOHN D. NEWBOLD <br /> QUARRY EXCAVATION APPLICATION NO. QX-90-1 <br /> OF CLAUDE C. WOOD CO. <br /> states that the project should not have been approved with a <br /> river crossing, given the CDFG's recommendation that the "no <br /> river crossing" alternative be adopted. <br /> Response: <br /> The letter from the CDFG, to which the appellant referred, <br /> states the nature of the department' s concerns with the <br /> project and what measures should be added to mitigate impacts <br /> associated with the use of the haul road and bridge crossing <br /> to transport extracted material to the processing plant. <br /> While it also states that the CDFG recommends the "no river <br /> crossing" alternative, it does not prohibit that crossing. <br /> The EIR consultant's response to this letter was to amend the <br /> Draft EIR' s mitigations to incorporate the department's <br /> recommended measures. The result is a reduction in the <br /> potential environmental impacts associated with the river <br /> crossing to less than significant levels. For this reason, <br /> the Planning Commission was able to approve the project with <br /> the river crossing, subject to specific Conditions of Approval <br /> to mitigate potential environmental impacts. The appellant <br /> has not provided specific evidence in his appeal to <br /> substantiate the existence of previously unidentified impacts <br /> related to the project or prove that the adopted Conditions of <br /> Approval are inadequate to prevent significant, adverse <br /> environmental impacts. <br /> FISCAL IMPACT: <br /> None. <br /> ACTION TO BE TAKEN FOLLOWING APPROVAL: <br /> None. <br /> Sincerely, <br /> CHET DAVISSO <br /> DIRECTOR <br /> CD:RL:fa <br /> Enc.
