AGREEMENT LEWIS MANOR WELL CONSTRUCTION(PHASE '1) AND DESTRUCTION. OF THREE ABANDONED WELLS AND TWO PUMP.HOUSES CIP 7502, 7503, & 7535 THIS AGREEMENT, made and entered into this day of between the City of Tracy, a Municipal Corporation,. ` Contractor. WITNESSETH: That, for and in consideration of the payments and agreements hereinafter mentioned, to be made and performed by the City, the Contractor hereby agrees with the City, at his own proper cost and expense,- to do all the work and furnish all the materials necessary to complete in .a.goodi workmanlike and substantial manner, the Bid dated copies of which Notice Inviting Bids and Bid are attached hereto, marked respectively Exhibits "A" and "B" and are made a part of this contract by reference thereto the same as though fully set forth herein. Said public work is located in the City of Tracy, County of San Joaquin,.State of California. tThe work shall be performed in accordance with the directions and specifications set forth in the above-named exhibits and also in accordance with the Standard' Specifications entitled "State of California,. Business and Transportation Agency, Department of Transportation, Standard Specifications, dated July, 1992, and the Standard Specifications of the City of Tracy, which Standard Specifications are hereby specifically referred to and. by such reference made a part hereof. The Standard Specifications are available at the Office of the Director of Public Works, City of Tracy. Said work and improvement to be done is.shown upon the plans attached hereto and made a part hereof by reference to the same as though said plans were fully set forth herein. The above-mentioned plans are also on file in the Office of the Director. of Public Works, City of Tracy. The Contractor agrees to rP prices and accept the rices fixed in the Contractors bid for said work as full compensation for furnishing all materials and doing all the work contemplated and embraced in this agreement; also for all loss or damage arising out of the nature of the work aforesaid, or from the action of the elements, or from any unforeseen difficulties or obstruction which may arise or be encountered in the prosecution of the work until its acceptance by the City; and all risks of every description with the work also of or all expenses incurred b or in consequence uence of the connected p Y q suspension or discontinuance of work, and for well and faithfully completing the work and whole thereof, in the manner and according to the plans and specifications and the requirements of the Director of Public'Works under them, to-wit: The City hereby promises and agrees with the Contractor to comply, and does hereby contract with the Contractor to provide the materials and to ,do the work according to the terms and conditions herein contained and referred to, for the prices E DIVISIONIV-17
