Contract based on the "Base Bid" alone or the "Base Bid" plus one or more, and in any combination, of <br /> the various "Additive Bid" (if any) items based upon the availability of revenue. All bids will be <br /> compared on the basis of the Engineer's Estimate of quantities of work to be done. <br /> (j) Execution of Contract: The Contract agreement shall be signed by the successful bidder and returned <br /> together with the contract bonds and proof of required insurance within ten (10) calendar days after the <br /> bidder has received written "Notice of Award" that the Contract has been awarded. Failure to return <br /> said Contract agreement, contract bonds and proof of required insurance within ten (10) calendar days <br /> may be considered breach of Contract. No bid shall be considered binding Ripon the City until the <br /> execution of the Contract is fully executed by all parties to the Contract. <br /> L In the event that a bidder breaches the contract by failing to execute a Contract and file acceptable <br /> bonds and insurance as provided herein within ten (10) calendar days, after the bidder has received <br /> "Notice of Award" that the Contract has been awarded, the proposal guaranty shall be forfeited to the <br /> City. Upon the full execution of the Contract agreement, written "Notice-to Proceed" will be issued by <br /> the City. <br /> (k) Return of Bidder's Guarantees: Fifteen (15) days after the award of the contract, the City Clerk will, <br /> upon request, return the bid guarantees accompanying each of the bids which are not to be considered <br /> in making the award. All other bid guarantees will be held until the contract has been finally executed, <br /> after which they will be returned to the respective bidders whose proposals they accompany. <br /> (1) Proiect Schedule and Order of Work: The Contractor shall submit, to the City Engineer, a practicable <br /> progress schedule within ten (10) calendar days of the written "Notice to Proceed", and within five (5) <br /> calendar days of the Engineer's written request at any other time. The schedule shall show the order <br /> in which the Contractor proposes to carry out the work, the dates on which he will start the several <br /> salient features of the work (including procurement of materials, plant and equipment), and the <br /> contemplated date for completing the said salient features. <br /> As provided in Section 5-1.05 of the State Standard Specifications, "Order of Work", the Contractor is <br /> advised that the Engineer may further direct by areas on the site(s), the order of installation of each <br /> major item of work so that succeeding major items of work may have timely ;and simultaneous access <br /> and that failure to comply with directions of the Engineer concerning the order of work may be cause <br /> for damages should work under the same be delayed. <br /> {m) Time of Completion and Li uidated Damages: The Contractor shall begin work within fifteen (15) <br /> Y <br /> calendar days after receiving "Notice to Proceed" and shall diligently prosecute all work to completion <br /> IE <br /> as specified before the expiration of <br /> One Hundred Twenty (120) CALENDAR DAYS <br />` from the date of receipt of the "Notice to Proceed" from the City. This project is tentatively scheduled <br /> to be awarded at the May 16, 2000, City Council meeting, and the "Notice to Proceed" is anticipated to <br /> be issued on or around June 1, 2000. <br /> In case of failure on the part of the Contractor to complete the work, the Contractor shall pay the City in <br /> liquidated damages the sum of Five Hundred dollars ($500.00) for each calendar day beyond the day <br /> specified until the project is completed. The Contractor will be given credit for inclement weather <br /> delays, as provided for in the State Standard Specifications. <br /> '(n) Project Estimate: The Engineer's Estimate will not be released until the bids are publicly opened. <br /> DIVISION 1-5 General Requirements <br /> Ik• <br />
