Box 440 <br /> Lodi, CA 95241 <br /> WATER CODE SECTION 13267 ORDER FOR REPORT, EAST-SIDE WINERY <br /> LODI, SAN JOA QUIN COUNTY <br /> On 14 August 2001 in response to a citizen complaint, staff inspected a wastewater spill site adjacent to <br /> the Mokelumne River. Staff discovered that the discharge was a continuing illegal discharge; <br /> photographs are attached. This discharge was the same as that identified in an 8 May 2001 site <br /> inspection. During that inspection, it was discovered that East-Side Winery was discharging wastewater <br /> to the area illegally. East-Side Winery initiated cleanup of the spill and you stated that piping <br /> connections would be investigated and repairs made to prevent further spills. <br /> In correspondence dated 17 May 2001, East-Side Winery described plugging the leaking pipe with an <br /> inflatable packer. During a 14 August 2001 conversation between you and Tim O'Brien of the Regional <br /> Board, you described vandalism of the packer. You also stated the pipe would be grouted with concrete <br /> by 17 August 2001. <br /> The discharge is a violation of Discharge Specification B.2 of Waste Discharge Requirements Order No. <br /> 5-01-172, which states: <br /> "The discharge of winery wastewater and stillage shall be to the designated disposal areas (i.e., <br /> lined pond) at all times". <br /> Pursuant to Section 13267 of the California Water Code, East-Side Winery shall submit a technical <br /> report by 24 September 2001 describing the repairs it has made to stop the on-going discharge of <br /> wastewater outside the designated disposal area. <br /> Section 13267 of the California Water Code states, "In conducting an investigation specified in <br /> subdivision (a), the regional board may require that any person who has discharged, discharges, or is <br /> suspected of discharging, or who proposes to discharge waste within its region, or any citizen or <br /> domiciliary, or political agency or entity of this state who has discharged, discharges, or is suspected of <br /> discharging, or who proposes to discharge, waste outside of its region that could affect the quality of <br /> waters within its region shall furnish, under penalty of perjury, technical or monitoring program reports <br /> California Environmental Protection Agency <br /> Recycled Paper <br /> The energy challenge facing California is real.
