I. INTRODUCTION <br /> A. Purpose <br /> The purpose of this Spill Prevention Control and Countermeasure (SPCC) plan is to describe measures <br /> implemented to prevent oil discharges from occurring at the Maxim Crane Works, L.P. (Maxim Crane Works) <br /> facility(the "site" or"facility"), and to prepare Maxim Crane Works to respond in a safe, effective, and timely <br /> manner to mitigate the impacts of a discharge. This SPCC Plan has been prepared in accordance with the <br /> requirements set forth in Title 40, Part 112 of the Code of Federal Regulations (40 CFR 112). <br /> B. Applicability (40 CFR 112.1) <br /> Facilities which are required to prepare and maintain SPCC Plans include those which store any form of <br /> oil in excess of the threshold quantities defined below and which are located such that the facility could <br /> reasonably be anticipated to release oil into navigable waters in quantities that may be harmful. For purposes of <br /> this plan, oil is defined in 40 CFR 112.2 to include petroleum, fuel oil, sludge, synthetic oils, mineral oils, oil <br /> refuse, or oil mixed with wastes other than dredged spoil, as well as vegetable oils and other forms of oil. <br /> Discharges of oil that"may be harmful" are defined in 40 CFR 110.3 as those that "(a) violate applicable water <br /> quality standards, or(b) cause a film or sheen upon or discoloration of the water or adjoining shorelines or cause <br /> a sludge or emulsion to be deposited beneath the surface of the water or upon adjoining shorelines." <br /> Facilities are not required to prepare SPCC Plans if the following minimum storage capacities are met: <br /> (1) Underground storage capacity of the facility is 42,000 gallons or less of oil; and <br /> (2) Aboveground storage capacity of the facility is 1,320 gallons or less. <br /> The combined capacity of aboveground storage tanks and containers used for storing liquid petroleum <br /> products at the Maxim Crane Works facility is approximately 12,940 gallons. In addition, storm water runoff <br /> from the facility discharges to a holding pond, which discharges to an unnamed canal during heavy precipitation <br /> events. During heavy precipitation events, this pond discharges to an unnamed canal. Based on a review of a <br /> topographic map of the area, the canal discharges to Duck Creek (approximately one and one quarter mile to the <br /> west), which in turn discharges to Walker Slough (approximately two miles to the west) and then the San <br /> Joaquin River(approximately four miles to the west), a navigable water of the United States. The Maxim Crane <br /> Works facility is, therefore, subject to the requirement to prepare and maintain an SPCC Plan. <br /> -1- <br />
