Mr. Steve Coldani GENESIS ENGINEERING&REDEVELOPMENT <br /> March 31,2009 <br /> Page 3 <br /> Further strengthening the conclusion that cattle wastes are the source of the nitrate found in <br /> groundwater is the nitrogen isotope composition in the samples. In the pond and ditch water,the <br /> nitrogen is lighter(a lower 15N)than in the groundwater(a higher 15N). This shift is what is to <br /> be expected based on the change of form and loss of mass of the nitrogen starting in the pond <br /> versus that ending in the groundwater. The mass and isotopic composition of nitrogen shows <br /> that the land application, ponds, and ditches are the source of the nitrate present in the <br /> groundwater beneath Lima Ranch. <br /> Reporting Requirements <br /> Under Section13267 of the California Water Code(CWC) the California Regional Water <br /> Quality Control Board- Central Valley Region issued Order No. R5-2007-0035(Waste <br /> Discharge Requirements General Order for Existing Milk Cow Dairies["Order"[). Among <br /> the Provisions included in the Order is a requirement that each dairy comply with Monitoring <br /> and Reporting Program No. R5-2007-0035 ("MRP"). Among the requirements of Section C. <br /> of the MRP titled"Priority Reporting of Significant Events (Prompt Action Required)"is a <br /> • requirement that the Discharger report any noncompliance with Prohibition A.4 in the Order'. <br /> Based on the data contained in this report,Lima Ranch is in Violation of Prohibition A.4 and <br /> is required to report that violation to the RWQCB within 24 hours of becoming aware of the <br /> violation. <br /> Respectfully submitted, <br /> Genesis Engineering & Redevelopment,LLC ag9�pR f 1 ti <br /> 1661 <br /> Victor A.Fisher,Ph.D., P.G., C.E.G. <br /> Attachments: as noted <br /> Prohibition A.4 of the Order states:"The collection,treatment,storage,discharge or disposal of wastes at an <br /> existing milk cow dairy that results in(1)discharge of waste constituents in a manner which could cause <br /> degradation of surface water or groundwater except as allowed by this Order,(2)contamination or pollution of <br /> • surface water or groundwater,(3)a condition of nuisance(as defined by California Water Code Section 13050)is <br /> prohibited". <br />
