As you may and should know, the Regional Board file contains
data from groundwater sampling conducted by the Lima Ranch during August 2008, and
as you may and should know, out of sixteen groundwater sampling locations, ten locations
revealed nitrate in excess of the MCL. Finally, as you may and should know, out of the ten
locations containing nitrate in excess of the MCL, seven were domestic wells located on
property owned or under the control of Lima Ranch. Copies of the data pulled from the
Regional Board file are attached.
In my client's continuing efforts to do what the Regional Board should be doing, additional
domestic wells at residences located in the general vicinity of the Lima Ranch were
sampled for nitrate earlier this week. Five out of six domestic wells located on property
either contiguous to or in close proximity to the Lima Ranch exceeded the MCL for nitrate,
with the sixth domestic well at 35.7 mg/L; not surprisingly, four domestic wells in the
general vicinity but not proximate to the Lima Ranch did not exceed the nitrate MCL. A
more detailed summary and analysis of this latest sampling will be provided to you next
week.
