CEASE AND DESIST ORDER NO. • <br /> -4- <br /> CITY OF ESCALON <br /> WASTEWATER TREATMENT FACILITY <br /> SAN JOAQUIN COUNTY <br /> 25. The issuance of this Order is an enforcement action by a regulatory agency and is exempt from the <br /> provisions of the California Environmental Quality Act, pursuant to Section 15321(a)(2), Title 14, <br /> California Code of Regulations. <br /> 26. On 2003, in Sacramento, California, after due notice to the Discharger and all other affected <br /> persons, the Regional Board conducted a public hearing at which evidence was received to <br /> consider a Cease and Desist Order. <br /> 27. Any person affected by this action of the Regional Board may petition the State Water Resources <br /> Control Board (State Board) to review the action in accordance with Section 2050 through 2068, <br /> Title 23, California Code of Regulations. The petition must be received by the State Board within <br /> 30 days of the date of this Order. Copies of the law and regulations applicable to filing petitions <br /> are available at http:/hvww.swrcb.ca.aov/water laws/cawtrcde/wgpetition instr html and will also <br /> be provided upon request. <br /> IT IS HEREBY ORDERED that, pursuant to Sections 13301 and 13267 of the California Water Code, <br /> the City of Escalon, its agents successors, and assigns, shall implement certain measures, and identify <br /> and implement facility improvements, in accordance with the scope and schedule set forth below to <br /> ensure long-term compliance with WDRs No. 5-00-142 or any revisions to those WDRs. <br /> Each document submitted under this Order shall bear the following certification signed by the <br /> Discharger: <br /> "I certify under penalty of law that I have personally examined and am familiar with the <br /> information submitted in this document and all attachments and that, based on my knowledge and <br /> on my inquiry of those individuals immediately responsible for obtaining the information, I believe <br /> that the information is true, accurate, and complete. I am aware that there are significant <br /> penalties for submitting false information, including the possibility of fine and imprisonment. " <br /> 1. The Discharger shall immediately comply with WDRs Order No. 5-00-142, Discharge <br /> Specification B.6, which states: "Objectionable odors originating at this facility shall not be <br /> perceivable beyond the limits of the wastewater treatment facility." <br /> 2. By 4 December 2003, the City of Escalon shall submit a technical report that (a) evaluates the <br /> organic loading and pH ranges which the City's industrial wastewater treatment plant is capable of <br /> treating in a manner that protects water quality and prevents nuisance odors, and (b) describes the <br /> actions needed to ensure that Escalon Premier Brand and Eckert Cold Storage comply with the <br /> loading limits at.the influent to the City plant. This second item shall include an evaluation of best <br /> practical treatment and control options including but not limited to: operating at a reduced organic <br /> loading rate, load checking, additional screening, pretreatment options including BOD reduction at <br /> the industrial facility, segregation of high strength waste streams, and changes to the waste <br /> characteristics as it is conveyed from the industrial facilities to the treatment plant. All physical <br /> and management changes shall be implemented prior to the start of the 2004 processing season. <br /> 3. By 15 January 2004, the City of Escalon shall submit a technical report showing that it has <br /> implemented a pretreatment program that requires the industrial wastewater dischargers to comply <br /> with loading limits that are within the treatment capacity of the City system. <br />
