BRED Rpt <br /> A <br /> UNITED STATES ENVIRONMENTAL PROTECTION AGENCY <br /> REGION IX <br /> 215 Fremont Street <br /> San Francisco, Ca. 94105 <br /> LETTER OF INTRODUCTION <br /> This letter is to certify that Thomas Beer, of Ecology and Environment, <br /> Inc., whose signature, photograph, and physical description <br /> appear below, is a duly authorized consultant for the Environmental <br /> Protection Agency. It is requested that, upon presentation of this <br /> letter, he be allowed to: <br /> a. enter any facility maintained by any person where hazardous <br /> wastes are generated, stored, treated, disposed of or transported; <br /> b, collect samples from your facility of any hazardous wastes and <br /> samples of any containers; <br /> c. have access to and copy all records relating to such wastes; <br /> d, determine compliance with any effluent limitation or other <br /> limitation, prohibition or effluent standard, pretreatment standard, <br /> standard of performance, levels of performance, sanitary landfill <br /> criteria, standards applicable to waste generators, transporters, and <br /> owners and operators of hazardous waste treatment, storage and disposal <br /> facilities, or other standards, any permit, compliance order or court <br /> order issues pursuant to the Resource Conservation Recovery Act; <br /> e. talk to employees concerning waste management practices; <br /> f. determine compliance with Section 311 of the Clean Water Act. <br /> The statutory basis for these inspections in contained in Section 104 <br /> of the Comprehensive Environmental Response, Compensation, and <br /> Liability Act of 1980; Section 3007 of the Resource Conservation and <br /> Recovery Act; Section 114 of the Clean Air Act; Section 9 of the <br /> Federal Insecticide, Fungicide and Rodenticide Act; Section 3 of the <br /> Toxic Substances Control Act; and Section 308 of the Clean Water Act. <br /> In addition, it is requested that he be allowed access to the scene of <br /> emergency incidents to: <br /> a. monitor cleanup/mitigation operations and assess potential <br /> impacts of the incident on public health and the environment; <br /> b. collect and analyze samples, and assess damages to natural <br /> resources and the environment. <br /> I <br />
