The report is complete and complies with Provision D.5. (d) of Waste Discharge <br /> Requirements Order No. 97-204. <br /> Confirmation samples collected from the excavated pond area and soil samples collected from MW-2r <br /> demonstrate that all contaminated soils were not removed. Waste Discharge Requirements Order No. <br /> 97-204 Discharge Specification B. 6. requires that: At closure of the lime ponds, all residual wastes, <br /> including liquids, sludges,precipitates, settled solids, and liner materials and adjacent natural geologic <br /> materials contaminated by wastes, shall be completely removed. If after reasonable attempts, the <br /> Discharger demonstrates the removal of all remaining contamination is infeasible, the impoundment <br /> shall be closed as a landfill. Because the lime waste has been determined to be a designated waste and <br /> in compliance with the requirements of the WDRs for your site, the lime pond area must be closed as a <br /> Class H landfill pursuant to the requirements in Section 21090 of Title 27. <br /> In covering the pond area with compacted soil and completing the Lime Pond Closure Report you have <br /> completed some of the landfill closure requirements. In summary to complete the lime pond area <br /> closure as a landfill Altherton Kirk must at a minimum comply with the following: <br /> Section 21090(a)—Final Cover Requirements: Filling the ponds with compacted fill to achieve a <br /> hydraulic conductivity of approximately 2.6 X 10-6 cm/sec is an acceptable engineered alternative to a <br /> prescriptive landfill cover in this case. <br /> Section 21090(b)—Grading Requirements: Filling and grading the pond area to shed storm water and <br /> prevent ponding complies with this requirement. <br /> Section 21090(c) General Post-Closure Duties: You must submit a post-closure maintenance plan <br /> addressing the following: <br /> 1. maintenance of the final cover, <br /> 2. leachate collection and recovery does not apply, <br /> California Environmental Protection Agency <br /> Zd Recycled Paper <br /> The energy eballenge facing California is real.
