Box 60 PERMIT/SERVICES <br /> Tracy, CA 95378 <br /> WATER CODE SECTION 13267 ORDER FOR TECHNICAL REPORTS, SPRECKELS SUGAR <br /> COMPANY TRACY FACILITY, SAN JOAQUIN COUNTY(Case#171) <br /> Waste Discharge Requirements Order(WDRs)No. 5-00-060 requires submittal of the following reports <br /> by 1 September 2001: <br /> 1. Reclamation plan for wastewaters that are not designated wastes. <br /> 2. A report that presents the results of waste and groundwater monitoring; determines background <br /> groundwater quality and evaluates whether unlined Waste Management Units (WMUs)presently <br /> contain designated wastes. <br /> To date neither of the above mentioned reports has been received by the Regional Water Quality <br /> Control Board. Submittal of these reports is still required despite the changes to your operation <br /> subsequent to the adoption of WDRs. Non-submittal of the reports is a violation of the reporting <br /> requirements in the WDRs and thus subject to administrative civil liability. <br /> California Water Code <br /> Section 13267 of the California Water Code states, "In conducting an investigation specified in <br /> subdivision (a), the regional board may require that any person who has discharged, discharges, or is <br /> suspected of discharging, or who proposes to discharge waste within its region, or any citizen or <br /> domiciliary, or political agency or entity of this state who has discharged, discharges, or is suspected of <br /> discharging, or who proposes to discharge, waste outside of its region that could affect the quality of <br /> waters within its region shall furnish, underpenalty ofperjury, technical or monitoring program reports <br /> which the regional board requires..The burden, including costs, of these reports shall bear a reasonable <br /> relationship to the need for the report and the benefits to be obtained from the reports." <br /> Section 13268 of the California Water Code states, "Any person failing or refusing to furnish technical <br /> or monitoring program reports as required by subdivision (b) of Section 13267, or failing or refusing to <br /> furnish a statement of compliance as required by subdivision (b) of Section 13399.2, or falsifying any <br /> information provided therein, is guilty of a misdemeanor and may be liable civilly in accordance with <br /> subdivision (b). <br /> California Environmental Protection Agency <br /> Qd Recycled Paper <br /> The energy challenge facing California is real.
