Metal fines were observed in a yellow container in the Main Shop(see photos IMG 0840-1), on the ground and <br /> on the equipment located next to the bead blasting cabinet in the Main Shop(IMG 0858-9), on an orange brake <br /> lathe located in the Main Shop (IMG 0860), on a brake lathe and in black drum labeled "Metal Only" in the Earth <br /> Moving Division (EMD) Field Service Shop(IMG 0881-5), and on the ground next to a brake lathe located in the <br /> Paint Shop in Building C, as indicated on the facility's site map(IMG 0939-40). According to Don Quilin, Dispatch <br /> Supervisor, the metal fines are recycled with the rest of the facility's scrap metal. <br /> 2. A mop bucket containing dark oily liquid was observed inside the Machine Prep area(IMG 0933). <br /> 3. Four non-empty aerosol cans, at least one of CAT Standard Performance Topcoat Yellow(458-9582) and at <br /> least one of CAT Standard Performance Primer-Yellow(458-9582),were found inside a trash bin located inside <br /> the Spray Paint Booth/Paint Shop areas as indicated on the facility's site map (IMG 0936-8). <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive <br /> or ignitable. Metal particles 100 microns or smaller in size must be handled and disposed of as hazardous waste <br /> if the metal is determined to be a hazardous waste. Metal particles larger than 100 microns in size can be recycled <br /> as scrap metal. <br /> CORRECTIVE ACTION: Immediately stop recycling the metal fines; stop disposing of non-empty aerosol cans <br /> into the trash; make a hazardous waste determination for the metal fines, the dark oily liquid, and the non-empty <br /> aerosol cans; and manage each waste according to Title 22 CCR. Use Safety Data Sheets (SDS),waste sampling <br /> and test results or other knowledge to make your hazardous waste determination. Waste testing must be done <br /> using methods specified in Title 22 CCR including Title 22 CCR sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes.
