As I am also
sure, they were not directing additional work on projects which they had no jurisdiction or intention to oversee.
Again, I request a face to face meeting with you, my client and I, so that we can explore opportunities to jointly
resolve these issues. As my client has stated, they are willing to be charged for oversight, if EHD will just give
them the time of day.
Thanks,
Robert "Tony" Martin, P.G., REA-I
Regional Manager/V.P.
Kleinfelder, Inc.
Central California Region
2825 East Myrtle Street
Stockton, CA 95205-4794
(209) 948-1345 x.215
(209) 948-0621 (fax)
>>> "Margaret Lagorio [EH]" <MLagorio@sjcehd.com> 7/14/2006 12:05:28 PM >>>
Tony,
I have reviewed the Environmental Health Department files and found that you requested entering into a
cleanup agreement for several issues at the former Spreckles site. The only written agreement that I can find
that was sent to the Department of Toxic Substances Control in October 1997 was for investigation around the
base of the cooling tower and a "Certification of Cleanup Goals" letter was provided by our Department on May
29, 1998. I also found "Certification of Cleanup Goals" letters from our Department for"Proposed commercial
and residential areas" covered by report number 2017R458, 2017R495, 2017R497, 2017R498, 2018R131,
2018LI86 and 2018R216 and "Proposed american Modular Facility referenced in reports 20171-342, 207RE077
and 20178501. There is also a "No Further Action Required" letter from our agency for a former farm house
underground storage tank(5000 gallon) dated December 7, 1998. If you would like a copy of these letters,
please let me know.
The only reports on the list you attached that correspond to the above letters are 207RE077 and 2017R501.
The list has 18 of the same reports that are on a list you prepared in July 2001, at which time we informed you
that we did not have staff to review and comment on the reports. The SB 1248 agreements are voluntary for
both the responsible party and the local agency. I have not found any agreement except for the one on the
cooling tower and our Department fulfilled that agreement with the Certification of Cleanup Goals letter. If you
have some other signed agreement from our department, please send me a copy of it. Our department still
does not have staff available to review and comment on the work performed. Under these circumstances I
don't think there is any reason to meet with you and your client.
Margaret Lagorio, Program Coordinator, REHS
San Joaquin County Environmental Health Dept
304 E.
