1 ENFORCEABLE AGREEMENT <br /> 2 Acme-Stockton Galvanizing Works <br /> Page 2 <br /> 3 <br /> 4 <br /> 5 3 . 1) Acme-Stockton shall continually maintain and keep an <br /> 6 asphalt and/or cement pavement cover/cap over the stabilized <br /> soil which has been deposited into the ground under the area <br /> 7i <br /> 8 delineated and defined by the southern one/half portion of the <br /> 9 ! building located on the property as described in Exhibit A. <br /> : <br /> 10 • 3 . 2) Acme-Stockton shall give the Department at ' least sixty <br /> 1111 (60) days advance written notice prior to any proposed <br /> 12excavation and/or earth movement on the capped area. The <br /> 1311 written notice shall be sent by certified mail to the <br /> 14I Department at the address set out in Paragraph 6. 0 of this <br /> 1511 Agreement. The written notice to the Department shall include <br /> 161 a detailed description of the work to be done and a map showing <br /> ii <br /> 171; the exact location of the proposed work. No excavation and <br /> ii <br /> 18 ! removal off-site of any stabilized soil from underneath the <br /> 19i' overlying asphalt and/or cement cap shall be allowed or shall <br /> I' <br /> 20 commence without the prior written approval of the Department. <br /> 21 All excavations of the stabilized soil must be tested for any <br /> 22 hazardous materials and then properly disposed as required by <br /> 231' law to a Class I Hazardous Waste Landfill or other appropriate <br /> i' <br /> 24 licensed landfill. <br /> I <br /> 25i: <br /> 3 . 3 ) Acme-Stockton shall review and re-evaluate the remedial <br /> 26 <br /> 27 <br /> action of the soil 'treatment/stabilization performed on the <br /> it <br /> JURT PAPER Ii <br /> ..
