If additional samples or characterization <br /> indicate otherwise, then the closure plan submitted in February 2001 might not be adequate. <br /> Secondly, Mr. Hayes requests confirmation that Fox River would not be required to submit a <br /> construction documentation report. For sites regulated by Title 27, a Construction Quality Assurance <br /> report is required. As previously stated, the Regional Board will not regulate the closure of the inactive <br /> sludge pond under Title 27 because it is considered inert waste. The closure plan submitted by Fox <br /> River, and reviewed by the Regional Board, indicated that"closure documentation"would be provided <br /> and would include an as-built survey of the final grades and drainages and verification of the thickness <br /> of the cover material. A report compliant with Title 27 was never proposed to begin with, but if Fox <br /> River wishes to close the pond in a manner other-than described in the closure report, a letter so stating <br /> would be appropriate and would be placed in the Regional Board files. <br /> The revised WDRs will be presented to the Board for approval on 14 June 2001. As indicated in the <br /> "Notice of Public Hearing"previously mailed to you, the Board meeting is scheduled for 9:00 AM at the <br /> Regional Board office at 3443 Routier Road, Suite A.
