The ground water model Iooked at the semi-perched aquifer zone, the upper aquifer zone. <br /> and.an intermediate aquifer zone. The semi-perched zone had an average TDS of 938 mg/1; <br /> the upper aquifer had an average TDS of 566 mg/l: and the intermediate aquifer had an <br /> average TDS of 422 mgA. Over a five-vear period. the model predicts that TDS in the semi- <br /> perched zone will improve as a result of the lowered TDS in the plant discharge. A report <br /> discussing the effect of the discharge on TDS in the three water-bearing zones is due in 1998 <br /> and every five years thereafter, <br /> 12. Following extensive ground water modeling, the Discharger's consultant David A. <br /> Lawrence,C.E.G. 618, stated in a lever. dated 21 September 1992,that the Discharger's <br /> discharge at I IW mg/l is not a designated waste and will not cause degradation of the waters <br /> of the State of California beyond ambient environmental conditions. The Discharger will <br /> continue ground water monitoring to confirm that its discharge is not impacting or degrading <br /> ground water. <br /> 13. The beneficial uses of the Stanislaus River and downstream waters are municipal. industrial. <br /> wid agricultural supply; recreation;esthetic enjoyment;navigation: and preservation and <br /> enhancement of fish, wildlife and other aquatic resources. <br /> 1.4. The beneficial uses of the ground war+r am municipal, industrial, and agricultural supply. <br /> 15. The Board adopted a Water Quality Control Plan. Third Edition,for the Sacramento River <br /> Basin and the San Joaquin River Basin(hereafter Basin Plan),which contains water quality <br /> objectives for all waters of the Basin- These requirements implement the Basin Plan. <br /> 16. The action to update waste discharge requirements for this facility is exempt from the <br /> provisions of the California Environmental Quality Act(CEQA) in accordance with Title 14, <br /> California Code of Regulations (CCR). Section 15301. <br /> 17. This discharge is exempt from the requirements of Title 23,CCR,Section 2510, et seq. <br /> (hereafter Chapter 15). The exemption. pursuant to Section 2511(b), is based on the <br /> foll©wing: <br /> a. The Board is issuing waste discharge requirements, <br /> b. The discharge complies with rhe Basin Plan. and <br /> c. The waste water does not need to be managed according to 22 CCR, Division 4, <br /> Chapter 30, as a hazardous waste. <br /> 18. The Board has notified the Discharger and interested agencies and persons of its intent to <br /> prescribe waste discharge requirements for this discharge and has provided them with an <br /> opportunity for a public hearing and an opportunity to submit their written views and <br /> recommendations. <br /> 19. The Board,in a public meeting,heard and considered all comments pertaining to the <br /> discharge. <br /> IT IS HEREBY ORDERED. that Fox ValleyCorporation and Fox River Paper Company, <br /> Ripon Mill. and its agents, assigns, and successors,in order to meet the provisions contained in <br />
