The <br /> following discussion includes; 1)waste discharge requirements (WDRs)based on Order No. 5-01-148 <br /> and associated Monitoring and Reporting Program (MRP); 2) Corrective Action Program pursuant to <br /> WDRs and Title 27, California Code of Regulations; 3)review of monitoring reports for the 1St, 2nd, and <br /> 3rd Quarter of 2003; and 4) areas of concern based on Regional Board staff's inspection of 21 October <br /> 2003. <br /> Waste Discharge Requirements i <br /> As the Monitoring and Reporting Program(MRP) states, "This is a Corrective Action monitoring <br /> program, the purpose of which is to classify the wastewater, to determine whether measures taken by the <br /> Discharger are sufficient to clean up the effects of past waste discharges to ground water and to <br /> determine if the continued discharge of wastewater to land needs to be contained in a waste management <br /> unit described in California Code of Regulations, Title 27 (Title 27). Therefore, based on the data <br /> collected from this monitoring program a final determination will be made on waste classification and <br /> proper containment of the wastewater." <br /> The effectiveness of the corrective action is required to be evaluated by comparing groundwater <br /> concentrations to both background concentrations and applicable water quality goals. Concentration <br /> limits have not been established for the Fox River facility. The record shows that Regional Board has <br /> requested Water Quality Protection Standards (WQPS) be developed for the site. Concentration limits, <br /> as part of WQPS, are required to be established pursuant to California Code of Regulations, Title 27, <br /> Division 2, Subdivision 1 (Title 27), Section §20390. Groundwater Limitations in the WDRs only state <br /> that discharge shall not cause groundwater to be degraded to concentrations greater than background <br /> water quality and taste- or odor-thresholds, and that chemical constituents may not be present in amounts <br /> that adversely affect agricultural use. Concentration Limits must be proposed by Fox River in <br /> accordance with Title 27 §20400 and can be set at background, or can be set at concentrations greater <br /> than background(referred to as "concentration limits greater than background", CLGB).
