CA0004006), SAN JOAQUIN COUNTY (CASE NO. 449) <br /> Simpson Paper Company, Ripon Mill , previously discharged wastewater under <br /> NPDES permit No. CA 0004006, Regional Board Order No. 83-001 . This permit has <br /> expired and will not be renewed. <br /> On 31 July 1987, Simpson Paper submitted a Report of Waste Discharge (RWD) for <br /> the discharge of treated process wastewater from the paper plant and the <br /> cogeneration facility to existing unlined ponds and agricultural fields. <br /> Discharge from the cogeneration plant is a "designated wasteii due to its salt <br /> content. Discharge of "designated waste" is subject to the requirements of <br /> the California Code of Regulations, Title 23, Division 3, Chapter 15 (Chapter <br /> 15) . In order to complete the RWD, you must submit the information required <br /> by Chapter 15. Enclosed is a checklist which we use to review RWDs. You may <br /> use the checklist or go directly to Chapter 15 to determine the RWD <br /> information requirements. <br /> Since the information requirements of Chapter 15 are extensive, we request <br /> that you propose a timetable for developing the RWD information and submitting <br /> it to the Regional Board. Your timetable must be submitted no later than 30 <br /> June 1991 . <br /> Water Code Section 13264 prohibits any new discharge of waste or any material <br /> change in any discharge until waste discharge requirements are issued or 120 <br /> days after a complete RWD is filed. The expiration of an NPDES permit is a <br /> material change. Also, Simpson Paper has not completed its RWD, therefore the <br /> 120 day clock has not begun. Simpson Paper is currently discharging waste <br /> without waste discharge requirements and may be subject to enforcement <br /> actions. <br /> Since we did not respond to Simpson Paper' s RWD for a lengthy period, we do <br /> not propose any enforcement action at this time. We would like to work with <br /> Simpson Paper to achieve compliance with the Water Code and Chapter 15. As <br /> long as Simpson Paper is making satisfactory progress towards completing its <br /> RWD we do not plan to consider enforcement action. <br />
