According to a document <br /> found at the facility at the time of inspection,brake lathe shavings are NOT <br /> considered a hazardous waste since they are managed as a recyclable metal by the <br /> (facility's) waste vendor. However,bills of lading and waste manifests reviewed at <br /> the time of inspection, do not demonstrate that the facility is either recycling the <br /> metal fines or disposing of them as hazardous waste. <br /> O'Reilly Response to Violation 1 <br /> Brake lathe shavings generated by our stores are classified as exempt scrap metal. <br /> Please reference attached manifest as supporting documentation of recycling. <br /> Observed Violation 2 <br /> A complete modified contingency plan was not posted at the facility. The emergency <br /> notification posted in the manager's, Daniel Castro, office was missing the location of <br /> fire extinguishers and spill control material. <br /> O'Reilly Response to Violation 2 <br /> Per the inspection report this violation was corrected during the inspection by the <br /> manager, Daniel Castro,who attached a facility site map to the emergency <br /> notification showing the location of fire extinguishers and spill control material. <br /> Observed Violation 3 <br /> The designated facility signed copy of Uniform Hazardous Waste Manifest number <br /> 006391926sks was not found on-site. <br /> O'Reilly Response to Violation 3 <br /> Please reference attached manifest as supporting documentation of our compliance. <br /> Observed Violation 4 <br /> According to Daniel Castro, Manager,the facility had its used oil picked up on <br /> 12/28/29, as indicated on the used oil container's hazardous waste label. However, <br /> a consolidated manifest receipt from 12/28/19 for the disposal of hazardous waste <br /> was not found on site during the inspection. <br /> O'Reilly Response to Violation 4 <br /> Please reference attached service receipts as supporting documentation of our <br /> compliance. <br /> RIGHT PA R T, RIGHT PRICE 'IIA RA NTEE! <br />
