I <br />Regulations, title 22, section 66265.192, subdivision (k); <br />2 <br />n. Failed to establish, implement, or submit to the responsible Certified Unified <br />3 <br />Program Agency, (as defined in Health and Safety Code sections 25123.7, <br />4 <br />subdivision (b) and 25404, subdivision (a)), a Hazardous Materials Business Plan <br />5 <br />for the Facilities, in violation of Health and Safety Code sections 25505, 25507, <br />6 <br />and 25508, and California Code of Regulations, title 19, section 2650; <br />7 <br />o. Failed to annually complete and submit an accurate Hazardous Materials Business <br />8 <br />Plan tor.the Facilities to the Certified Unified Program Agency, in violation of <br />9 <br />Health and Safety Code sections 25508 and 25508.2, and California Code of <br />1Q <br />Regulations, title 19, section 2654; <br />11 <br />p. Failed to complete and submit to the Certified Unified Program Agency, the <br />12 <br />Business Activities page and/or Business Owner/Operator Identification page for <br />13 <br />the Facilities, in violation of Health and Safety Code section 25508 and California <br />14 <br />Code of Regulations, title 19, section 2652; <br />15 <br />q. Failed to update and submit, for each Facility, the Hazardous Materials Business <br />16 <br />Plan to the Certified Unified Program Agency within thirty (30) days of a <br />17 <br />substantial change to any portion of the Hazardous Materials Business Plan, <br />18 <br />including inventory changes or facility information, in violation of Health and <br />19 <br />Safety Code section 25508. 1, subdivisions (a -f) and California Code of <br />20 <br />Regulations, title 19, section 2654; <br />21 <br />r. Failed to complete and submit, for each Facility, an Annotated Site Map to the <br />22 <br />Certified Unified Program Agency, in violation of Health and Safety Code <br />23 <br />sections 25505, subdivision (a)(2), 25508. J, subdivision (f), and California Code <br />24 <br />ofRegulations, title 19, section 2652., subdivision (a)(3); <br />25 <br />s. Failed to have a Hazardous Materials Business Plan for the Facilities readily <br />26 <br />available to the personnel of the business or the responsible Certified Unified <br />27 <br />Program Agency, in violation of Health and Safety Code section 25505, <br />28 <br />subdivision (c); <br />-9- <br />COMPLAINT FOR INJUNCTIVE RELIEF, CIVIL PENALTIES, AND OTHER RELIEF <br />
