($500. 00) . Any cost exceeding five hundred dollars ($500 . 00) shall <br /> be paid equally by Grantor and Grantee. <br /> This easement is granted to Grantee and their successors and <br /> assigns together with the right of ingress to and egress from and <br /> over said lands for all or any of the purposes aforesaid. It is <br /> the intention of the parties hereto that Grantor may continue to <br /> use the surface of land herein described, provided, however, that <br /> Grantor shall not construct or permit to be constructed any <br /> permanent structure upon the easement land which would interfere <br /> with the Grantee' s exercise of the rights hereby conveyed. <br /> IT IS FURTHER AGREED AS FOLLOWS: <br /> 1 . That the Grantee will bury the septic disposal system and all <br /> appurtenances thereto to a sufficient depth so as not to <br /> interfere with the ordinary cultivation of the soil, and in <br /> conformance with County Code. <br /> 2 . The Grantee shall have the right from time to time to cut or <br /> clear trees, brush and other obstructions on said right-of-way <br /> that might interfere with the operation or maintenance of <br /> Grantee' s facilities. <br /> 3 . That Grantee will replace, rebuild or pay damages to the <br /> satisfaction of the Grantor or its representative any and all <br /> damages caused by or resulting from the exercise of the rights <br /> herein granted, said damage, if not mutually agreed upon, to <br /> be ascertained and determined by three disinterested persons, <br /> one to be appointed by the Grantor, one by the Grantee, and <br /> the third by the two so appointed, and the award of such three <br /> persons or any two of them shall be final and conclusive. <br /> 4 . That the rights of the Grantee may be assigned in whole or in <br /> part. <br /> 5. The Grantee agrees to save and hold Grantor harmless from <br /> responsibility or liability for injury or damage caused from <br /> the construction, operation or maintenance of said septic <br /> system. <br /> 6. This easement shall continuously exist until such time as the <br /> public sewer service is available to the site and the site is <br /> connected to the public system. At the time of connection, <br /> this easement shall be deemed abandoned and the Grantee, upon <br /> demand of the Grantor, shall execute and deliver to Grantor a <br /> quitclaim of all rights to this easement, thereby terminating <br /> the same. <br />
