Item No. 10
PC : 1-16-86
VR-86-2
Page 1
RECOMMENDATION
It is recommended that the Planning Commission:
1 . Approve the Negative Declaration;
2 . Approve the Variance request for parcel A only, based on the
findings noted and subject to the attached conditions ; and
3 . Deny the Variance request for Parcels B and C.
FINDINGS FOR PROPOSED PARCEL A
1 . There are special circumstances applicable to the property
where the strict application of the zoning regulation deprives
the property of privileges enjoyed by other properties in the
vicinity and under identical zoning classification because
the small , irregularly-shaped Parcel A is physically
separated from the remainder of the property by a public road
(Morse Road) , which is an existing unique, physical condition
not applicable to other properties in the area and zone .
2 . The granting of the Variance will not constitute a grant of
special privileges inconsistent with the limitations upon
other properties in the vicinity and zone in which the prop-
erty is situated because the property is already isolated
and below zone minimum.
3 . The Variance will not authorize a use or activity which is
not otherwise expressly authorized by the zone regulation
governing the parcel of property because granting the
Variance for Parcel A would not authorize any uses incon-
sistent with the Zoning Ordinance.
FINDINGS FOR PROPOSED PARCELS B AND C
1 . There are no special circumstances applicable to the prop-
erty, including size, shape, topography, location, or
surroundings where the strict application of the zoning regu-
lation deprives the property of privileges enjoyed by other
properties in the vicinity under identical zoning classifica-
tion because the area comprised of proposed Parcels B and C
is consistent with the zoning and General Plan designation.
2 . The granting of the Variance will constitute a grant of spe-
cial privileges inconsistent with the limitations upon other
properties in the vicinity and zone in which the property is
situated because the combined area of Parcels B and C meets
