Item No. 10 <br /> PC : 1-16-86 <br /> VR-86-2 <br /> Page 1 <br /> RECOMMENDATION <br /> It is recommended that the Planning Commission: <br /> 1 . Approve the Negative Declaration; <br /> 2 . Approve the Variance request for parcel A only, based on the <br /> findings noted and subject to the attached conditions ; and <br /> 3 . Deny the Variance request for Parcels B and C. <br /> FINDINGS FOR PROPOSED PARCEL A <br /> 1 . There are special circumstances applicable to the property <br /> where the strict application of the zoning regulation deprives <br /> the property of privileges enjoyed by other properties in the <br /> vicinity and under identical zoning classification because <br /> the small , irregularly-shaped Parcel A is physically <br /> separated from the remainder of the property by a public road <br /> (Morse Road) , which is an existing unique, physical condition <br /> not applicable to other properties in the area and zone . <br /> 2 . The granting of the Variance will not constitute a grant of <br /> special privileges inconsistent with the limitations upon <br /> other properties in the vicinity and zone in which the prop- <br /> erty is situated because the property is already isolated <br /> and below zone minimum. <br /> 3 . The Variance will not authorize a use or activity which is <br /> not otherwise expressly authorized by the zone regulation <br /> governing the parcel of property because granting the <br /> Variance for Parcel A would not authorize any uses incon- <br /> sistent with the Zoning Ordinance. <br /> FINDINGS FOR PROPOSED PARCELS B AND C <br /> 1 . There are no special circumstances applicable to the prop- <br /> erty, including size, shape, topography, location, or <br /> surroundings where the strict application of the zoning regu- <br /> lation deprives the property of privileges enjoyed by other <br /> properties in the vicinity under identical zoning classifica- <br /> tion because the area comprised of proposed Parcels B and C <br /> is consistent with the zoning and General Plan designation. <br /> 2 . The granting of the Variance will constitute a grant of spe- <br /> cial privileges inconsistent with the limitations upon other <br /> properties in the vicinity and zone in which the property is <br /> situated because the combined area of Parcels B and C meets <br />
