ATTACHMENT A <br /> CONTRACT CANCELLATION <br /> In order to grant tentative approval to an application for <br /> contract cancellation, the Board of Supervisors must make either <br /> finding (a ) or finding (b) . This cancellation is proposed to be <br /> made under finding (a ) as follows : <br /> (a) The Cancellation is consistent with the purposes of the <br /> Williamson Act because: <br /> ( 1 ) The Cancellation is for land on which a Notice of <br /> Nonrenewal has been served pursuant to Section 51245 of <br /> the Government Code. <br /> ° This finding can be made because a Notice of Nonre- <br /> newal was filed effective, March 1 , 1984 . <br /> ( 2 ) The Cancellation is not likely to result in the removal <br /> of adjacent lands from agricultural use. <br /> ° This finding can be made because adjacent lands to <br /> the south are not proximate to the airport, do not <br /> have urban services , and have historically been <br /> utilized for farm land. Adjacent lands to the north <br /> and west are already designated as urban. <br /> ( 3 ) The Cancellation is for an alternative use which is con- <br /> sistent with the applicable provisions of the County <br /> General Plan. <br /> This finding can be made because the subject property <br /> has been designated as General Industrial on the Land <br /> Use/Circulation Element map and a specific project <br /> consistent with this designation has been proposed. <br /> ( 4 ) The Cancellation will not result in discontiguous pat- <br /> terns of urban development. <br /> This finding can be made because the subject property <br /> is adjacent to existing urban development and no <br /> discontinuity will result from development of this <br /> property. <br /> (5 ) There is no proximate noncontracted land which is both <br /> available and suitable for the use to which it is pro- <br /> posed the contracted land be put, or , development of the <br /> contracted land would provide more contiguous patterns <br /> of urban development than development of proximate <br /> noncontracted land. <br /> BOS LETTER PAGE 5 <br />
